Judge SC Gupta passed the interim order on Monday while hearing a petition filed under HUL's Trade Marks Act. The petition urges Emami to ban the use of the trademark 'glow and handsome'. HUL recently used the word 'glow and handsome', removing the word 'fair' from a skin care product.
Emami claimed that she owns the trademark and is going to introduce a skincare cream for men with the same name. The High Court said, HUL has already introduced its products in the market with the trademark while Emami is in the process of being introduced. According to the order, “Emami's application for registration of trademark is also of later date.”
The court said that if products under the same trademark come on the market then it will cause confusion among the people. The High Court held that until the matter was finally settled, the use of the words 'glow and handsome' was banned on Emami.
