Awasthi is also among the petitioners who had on July 2 requested the CBI or NIA to investigate the killing of eight policemen and the encounter of Vikas Dubey and some of his associates.
In the application, there has been an objection to the inclusion of former Director General KL Gupta in the Commission, that the Commission should be reconstituted and it should be replaced by another former Director General instead of KL Gupta. Awasthi alleges that after the Kanpur encounter, KL Gupta, while talking to the media, defended the encounter, so there is a possibility of bias in this investigation.
Significantly, the Supreme Court had directed the restructuring of the commission set up by the UP government to investigate the encounter case of vicious criminal Vikas Dubey of Kanpur and the murder of eight policemen in Bikaru village.
The Supreme Court had approved the proposed names of the Uttar Pradesh government in the Commission and included retired Supreme Court judge BS Chauhan and former DGP KL Gupta. Justice Chauhan has been made the head of the commission of inquiry. It is known that former judge of Allahabad High Court Shashikant Aggarwal is already in the commission.
