A bench of Justice L Nageswara Rao, Justice Hemant Gupta and Justice S Ravindra Bhat referred the matter to a larger bench which would be constituted by Chief Justice SA Bobde. In these petitions, the validity of the law making provision for reservation for Maratha community in education and employment has been challenged.
The apex court said that no change will be made in the status of those who have taken advantage of the 2018 law. The Maharashtra government enacted the Reservation in Education and Employment Act, 2018 for socially and economically backward classes in the Maratha community.
The Bombay High Court in June last year upheld the law, stating that 16 per cent reservation is not justified and instead there should be no more than 12 per cent reservation in employment and 13 per cent in admissions cases.
