Advocate MS Singhvi, appearing for the state government, said that the state government has the right to decide the recruitment process. He also presented the 1964 judicial parable of the Supreme Court in this regard. It says that constable, head constable and ASI recruitment is done at the local level only. At the same time, in a similar case, the big bench has decided that the government decides the recruitment process for nursing recruitment. On 24 February, the Single Bench, while giving its verdict on the petition of Zaheer Ahmed, had considered it wrong to make merit district-wise in the case. The single bench had asked it to make a single merit for the entire state, considering it a violation of the Rajasthan Police Act 2009 and Rajasthan Police Subordinate Service Rules-1989 along with the constitutional provisions. After the order of the bench, now the state government will be able to proceed with the release of district wise results of the constable recruitment. It is worth noting that last year, about 12.41 lakh candidates had appeared for 5,438 posts.
